Grandparents’ rights is a broad sub-section of family law. It covers grandparent adoption, grandparent visitation, and grandparent custody. There are many reasons why you would be entitled to claiming custody or visitation rights for your grandchildren. However, courts will prioritize the rights of the parent, so you’ll need an experienced attorney at your side. Hendershot, Cannon, Martin & Hisey, P.C. has experience successfully handling all family law matters involving grandparents’ rights. In our experience, we’ve learned an important truth:
Children benefit from relationships with their grandparents.
Relationships with grandparents create some of the strongest, most important bonds in children's lives. Many kids find stability in their grandparents' homes when their own homes are chaotic and their parents are unreliable. Sadly, these vital relationships can suffer or become severed when major events change the picture.
Conversely, grandparents often step in as primary caregivers when parents pass away or cannot fulfill this role—and this creates an array of tough challenges, both legally and personally. In either situation, navigating the complex legal landscape or establishing your state-recognized rights as a grandparent is impossible without an experienced lawyer at your side. Speak with Hendershot, Cannon, Martin & Hisey, P.C. today.

Generally, courts do not intervene in a family dispute unless children are suffering or at risk. To obtain visitation rights, you must establish that this would be in the children's best interests, but that is not enough. You may also need to cite the impact of divorce, neglect, abuse, or the death or incarceration of a parent.
If a parent-child relationship has been terminated by court order or your grandchild lived with you for six months or longer at some point, you may be able to obtain visitation rights on that basis.
